Your Name Is on the Label—Do You Own It?

A founder's name on a label signals identity and reputation; it does not, by itself, answer who owns the registered mark, company, domain, likeness permissions, archive authority, or power to approve future uses.

The proposition

In the United States, the legal analysis starts by separating the human being from the asset records built around the name. Section 2(c) of the Lanham Act addresses federal registration of a mark containing the name, portrait, or signature identifying a particular living individual without written consent. Section 10 addresses assignment of registered marks and applications under specified conditions. Neither provision says that a name printed on a garment automatically proves every form of control.

This distinction is institutional, not merely technical. A founder may be the public meaning of a label while a company owns registrations, a license defines permitted uses, a platform account has another administrator, and an archive agreement controls preservation or access. The correct first move is an evidence map: exact asset, record owner, territory, term, authority, recovery path, and unanswered counsel question.

01–04

The institutional sequence

01 · IDENTIFY

Which name is this?

Separate the person's legal name, professional name, signature, portrait, label name, house name, monogram, product line, domain, and social handle. Similar public presentation does not make these one legal object.

02 · LOCATE

Where is control recorded?

For a U.S. federal mark, inspect the registration and any recorded assignments; for the company, inspect governing records; for domains and accounts, inspect registrant and administrator access; for licenses and approvals, inspect executed agreements. Never substitute the label display for the record.

03 · DISTINGUISH

What power does each record confer?

Registration, ownership, licensed use, consent, approval, corporate voting, employment authority, account administration, and archive access answer different questions. A founder can possess some and not others.

04 · ESCALATE

What cannot this audit decide?

Common-law rights, state publicity law, foreign law, contractual interpretation, beneficial ownership, validity, priority, and disputed facts require jurisdiction-specific investigation and qualified counsel. The map prepares that review; it does not replace it.

COUNTERPOINT

What this framework could get wrong

Separating the name into assets can make identity look purely transactional. A personal name also carries dignity, biography, community meaning, and reputational stakes that a registry cannot fully describe. Conversely, emotional identification with a label cannot resolve an ownership dispute. The exhibition keeps both truths visible without converting either into a legal conclusion.

FIELDWORK

Do the work now

Use this as a working session, not a score.

  1. List every personal, label, company, domain, handle, signature, portrait, and archive use.
  2. Attach the exact registration, account, entity, or agreement record supporting each claimed form of control.
  3. Record owner, authorized user, administrator, territory, term, renewal, approval right, and recovery route.
  4. Mark every unresolved common-law, publicity, contract, foreign-law, or beneficial-ownership question for counsel.

What the sources establish

Section 2(c) of the Lanham Act bars registration of a mark that consists of or comprises the name, portrait, or signature identifying a particular living individual without written consent.

A federally registered mark and the human identity it references are distinct interests; recorded assignments may transfer a registered mark subject to statutory conditions.
