Proof of Making

Proof of making is a chain of contemporaneous records that can support authorship, development, contribution, and custody questions without pretending that documentation itself decides ownership.

The proposition

A finished garment may carry no visible trace of the rejected sketch, pattern alteration, fitting correction, source-file history, collaborator note, or payment record that produced it. Copyright Office guidance distinguishes authorship and ownership concepts; federal law provides rules for initial ownership and transfers in the United States. Those rules still require facts. A timestamp, signature, invoice, or file hash can be evidence, but no single artifact answers every dispute.

The maker’s proof system therefore preserves the sequence rather than manufacturing certainty after conflict. It connects stable identifiers, original files, version histories, material samples, contributor statements, agreements, payments, approvals, publications, and custody events. It also records missing and contested evidence. The goal is not defensive surveillance of collaborators. It is a proportionate, consent-aware history that lets each contribution remain attributable and reviewable.

The institutional sequence

01 · ORIGIN

What is the earliest reliable record?

Preserve native file, physical notebook or sample, creator, date basis, device or system context, identifier, and custody. Distinguish recorded time from an unverified recollection.

Can development be reconstructed?

Link versions, annotations, patterns, fittings, samples, approvals, and rejected alternatives. Keep contributor corrections and disagreements rather than overwriting them.

03 · RIGHT

What does the evidence not decide?

Separate factual creation history from U.S. copyright authorship, work-made-for-hire, transfer, contract, patent, design, trademark, foreign-law, and confidentiality questions.

Can the chain survive movement?

Record every deposit, handoff, copy, migration, sale, loan, publication, return, and deletion with responsible person and integrity check.

COUNTERPOINT

What this framework could get wrong

Evidence systems can become coercive, invade privacy, or privilege whoever controls the platform. Contributors need notice, access, correction, confidentiality, proportional retention, and a way to preserve their own record.

FIELDWORK

Do the work now

Use this as a working session, not a score.

  1. Choose one look and reconstruct its earliest-to-final evidence chain.
  2. Ask each contributor to verify role, version, credit, and disagreement.
  3. Attach governing agreements without treating them as public media.
  4. Send disputed authorship, ownership, priority, and jurisdiction questions to counsel.

What the sources establish

A contemporaneous evidence chain can support but does not automatically decide a rights dispute.
